本最终用户许可协议（下称「本协议」）是您（下称「用户」）与
Nexsteaduser（下称「所有者」）之间就
Soke 操作系统（含 SNMK 内核（SPT 宏内核 + BSD 组件层）、
Soke Desktop Environment 桌面、Soke64 API 及相关文档，下称「本软件」）达成的法律协议。
安装、复制或以任何方式使用本软件，即表示您同意接受本协议全部条款的约束。
1. 专有软件声明（Proprietary Status）
本软件是闭源专有软件（Closed-Source Proprietary Software）。 本软件不是开源软件，不适用 MIT 许可证或任何宽松许可协议。 所有者保留对本软件的全部权利、所有权与利益，包括一切知识产权。
2. 许可授予（Grant of License）
所有者授予用户一项有限的、非独占的、不可转让的、可撤销的许可， 允许用户在遵守本协议的前提下，将本软件的二进制形式仅用于个人或内部 业务用途进行安装与使用。
3. 使用限制（Restrictions）
未经所有者书面明确许可，用户不得：
a. 复制、出版、发布、再分发、再许可或出售本软件或其任何部分； b. 修改、改编、翻译或基于本软件创作衍生作品； c. 对本软件进行逆向工程、反编译、反汇编，或以任何方式试图获取源代码； d. 删除、更改或遮挡本软件中的任何版权、商标或专有标识； e. 以违反适用法律的方式使用本软件。
4. 第三方组件（Third-Party Components）
本软件可能包含按各自许可证授权的第三方组件（见 THIRD_PARTY.md）。
相应组件的许可证条款继续适用于相应组件，并予以保留。
5. 免责声明（Disclaimer of Warranty）
本软件按「现状」（AS IS）提供，不附带任何明示或暗示的担保， 包括但不限于适销性、特定用途适用性及不侵权的担保。 使用本软件的全部风险由用户自行承担。
6. 责任限制（Limitation of Liability）
在任何情况下，所有者均不对因使用或无法使用本软件而产生的任何索赔、 损害或其他责任负责，无论基于合同、侵权或其他原因， 包括但不限于直接、间接、附带、特殊或后果性损害。
7. 协议终止（Termination）
用户违反本协议任何条款时，本许可自动终止。终止后， 用户必须停止一切使用并销毁本软件的全部副本。
8. 完整协议与适用法律（General）
本协议构成双方就本软件达成的完整协议。本协议受适用法律管辖。 如本协议任何条款被认定为无效或不可执行，其余条款继续有效。

End User License Agreement (EULA) — Soke
This is a legal agreement between you (the "User") and
Nexsteaduser (the "Owner") for the
Soke operating system (including the SNMK kernel — the SPT monolithic
kernel plus its BSD component layer — the Soke Desktop Environment desktop, the
Soke64 API, and related documentation, the "Software").
- The Software is closed-source proprietary software. It is NOT open source and is NOT licensed under the MIT license or any permissive license.
- The Owner grants the User a limited, non-exclusive, non-transferable, revocable license to install and use the Software in binary form solely for personal or internal business purposes.
- The User may NOT copy, redistribute, sublicense, sell, modify, or create derivative works of the Software, nor reverse engineer, decompile, or disassemble it, nor remove proprietary notices, without the Owner's prior written consent.
- Third-party components remain governed by their own licenses
(see
THIRD_PARTY.md). - The Software is provided "AS IS" without warranty of any kind. The Owner shall not be liable for any damages arising from its use.
- This license terminates automatically upon breach; the User must then cease use and destroy all copies.
